Modulating brake lights - are they legal?

Pulsing (modulating) brake lights -without a third brake light on the car.

I believe the third brake light can flash but not the others. I read something about that a while back but can't seem to find it as of late. I'll look into it further.

I had GM Junkie install the pulsating break light when I got my 08 .Has it ever saved being rear ended?Don't know but I certainly feel a comfort level on I4 .
