Speeding Ticket

Star had to go to Daytona for a couple of days. Decided to take I-75 to Ocala and head East on SR-40. Called me from her motel and tells me she got a speeding ticket. Of course she was in "Lil'Brat". She told me she had been following this semi "for miles" and finally got a clear shot to pass him. In the left lane "hitting it" and radar goes off! She gets back in and the Statie makes a u-turn and pulls her over. He had clocked the semi at 62 (60 zone) and got her at 72. Knocked it down to 69. I've always been told that you could "speed" while passing as long as you came back down to the limit when passed. I know, I know if the semi was doing 62 why pass? We all have been stuck behind a semi and know that their speed varys and once you are ahead of them you generally stay ahead. The cop wouldn't listen and gave her the ticket anyway. $139...should I fight it? In Daytona??? :shrug01:

Not much grounds to fight really. If it is a first ticket, take the traffic school on line and no points. Since he dropped it down in my opinion you got off easy. Bad timing really.

Unfortunately, Brads probably correct. It would likely cost more (time, money and effort) to fight it than to pay it or do driving school.

You can do school by internet, dvd or in person. There are even a few comedy clubs around that are pretty decent:thumbsup:

69 or 72, it's still over 60 and the judge (or magistrate) probably won't care about the trooper dropping the speed down.

About the only hope you'd have of winning would be:

1) The Trooper fails to appear (not likely, the eat this crap up!:rofl1.
2) The Trooper fails to bring in the required documentation (radar log, calibration cert for both the unit and the car (since he was moving-and highly unlikely).
3) The unit is was out of claibration at the time of the ticket (again, not likely).

If she has a clean record, the trooper doesn't object (probably won't) and there was no discernable hazard to her actions, the judge may do a withold, no fine, no points and court cost only.
But in this era of fiscal infidelity among local and state governments, I wouldn't hold my breath for that either

Do the school, pay the reduced cost, guarantee no points on the DL and consider it a life lesson:thumbsup:

And for the record, you can pass as long as it's safe to do so, there are no signs or markings to prohibit the move and you do not exceed the posted speed limit.

Not sure if it's just my county or statewide, but there is no more "reduced cost" if taking the school election. It's actually a bit higher. I don't have my cheat sheet with me or I'd tell you how much more it is.

Came out to being about $20 more expensive for the school election. And then I had to pay for the school. The Tax Collection Patrol has it figured out how to squeeze the most money out of each mph.:hehehe:

It's been about a year or so since I wrote a ticket and about 3-4 years since I taught the school.

I need to get up to speed on this crap!

Do they still with hold the points?

If so, depending on your insurance company, it would still be worth it.

Some companies have a "forgiveness policy" and will disregard 1 crash ro ticket. Get a second one though and they'll jump on you like a 2 year old in a bouncy house!!!

I'm with Mannings, it's not the $$$, it's the points and the insurance.

Hell, if the insurance didn't go through the roof and there wasn't a chance of losing your license, I'd form a trust fund and haul arse everywhere:lmao::lmao:
